1. Agreement to Terms

By accessing or using the Moonlit Games website, any games developed by Moonlit Games (including but not limited to "Chill Gorilla"), or any services provided through Moonlit APIs (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you may not access or use the Services.

Moonlit Games is a PC and VR game development studio based in Richmond, Virginia, United States.

2. Definitions

  • "Moonlit Games" (also referred to as "we," "us," or "our") refers to the game development studio and its affiliated services.
  • "User" (also referred to as "you" or "your") refers to any individual who accesses or uses the Services.
  • "Services" refers to all products, games, websites, APIs, and related services provided by Moonlit Games.
  • "Moonlit APIs" refers to the developer tools and application programming interfaces provided by Moonlit Games.
  • "Content" refers to any text, images, audio, video, code, or other materials made available through the Services.

3. Use of Services

3.1 Eligibility

You must be at least 13 years of age to use the Services. If you are under 18, you must have the consent of a parent or legal guardian to use the Services.

3.2 Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Services in any way that violates applicable federal, state, or local law or regulation.
  • Attempt to gain unauthorized access to any part of the Services, other accounts, computer systems, or networks connected to the Services.
  • Use any automated system, bot, scraper, or data mining tool to access the Services without our express written permission.
  • Transmit any viruses, malware, or other malicious code through the Services.
  • Harass, abuse, threaten, or harm other users of the Services.
  • Reverse engineer, decompile, or disassemble any game or software provided by Moonlit Games.
  • Exploit bugs, glitches, or cheats in any Moonlit Games title for unfair advantage.

3.3 Account Responsibility

If you create an account with any Moonlit Games service, you are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You accept responsibility for all activities that occur under your account.

4. Intellectual Property

4.1 Ownership

All content, games, software, graphics, logos, trademarks, and other intellectual property associated with the Services are owned by or licensed to Moonlit Games. This includes, without limitation, the "Moonlit Games" name and logo, "Chill Gorilla," "Moonlit APIs," and all related branding.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

4.3 User Content

Any content you submit, upload, or transmit through the Services remains your property. However, by submitting content, you grant Moonlit Games a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display such content in connection with the Services.

5. Moonlit APIs

5.1 API Access

Access to Moonlit APIs may be subject to additional terms, rate limits, and usage guidelines that will be provided when the API portal launches. API access may be granted or revoked at our sole discretion.

5.2 API Usage Restrictions

When using Moonlit APIs, you agree to:

  • Comply with all rate limits and usage guidelines.
  • Not use the APIs to create competing products or services.
  • Not redistribute API access or credentials to third parties.
  • Not use the APIs for any unlawful or harmful purpose.
  • Display proper attribution when using data from Moonlit APIs.

6. Games & Virtual Content

6.1 Game License

Purchases of Moonlit Games titles grant you a license to use the game software. You do not own the game itself; you own a license to play it subject to these Terms.

6.2 Virtual Items

Any virtual items, currency, or in-game content acquired through our games are licensed to you and are not your property. We reserve the right to manage, modify, or remove virtual content at any time.

6.3 VR Safety

Our VR titles, including Chill Gorilla, involve immersive virtual reality experiences. You acknowledge that VR experiences may cause motion sickness, disorientation, or discomfort. You use VR products at your own risk and should take regular breaks during gameplay.

7. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of information as described in our Privacy Policy. We are committed to protecting your personal information and will not sell your data to third parties.

8. Disclaimers

8.1 "As Is" Basis

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Moonlit Games makes no warranties, expressed or implied, regarding the Services, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 No Guarantee of Availability

We do not guarantee that the Services will be available at all times. We may modify, suspend, or discontinue any part of the Services at any time without notice.

9. Limitation of Liability

To the fullest extent permitted by law, Moonlit Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, including but not limited to loss of data, revenue, or profits.

10. Indemnification

You agree to indemnify, defend, and hold harmless Moonlit Games and its team members (including but not limited to Indigo577/Liam Milby, 10StarGeneral, Star, Ethan Parker, and Ben Robinson) from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Richmond, Virginia.
